    • Everest Veterinary Care PLLC dba “InstaVet”, which may also be referred to as ‘we’, ‘us’ or ‘our’ as the context requires.
    • “Terms” means the InstaVet Terms of Service and Privacy Policy.
    • “Website” means the website of www.instavet.com together with, unless the context otherwise requires, its content.

Welcome! The following privacy policy (the “Privacy Policy”) outlines the types of personal information that instavet Technology, Inc. (“we,” “our,” or “us”) collects when operating our website https://www.instavet.com (the “Site”) and the instavet or InstaVet online services and mobile applications (collectively with the Site, “instavet” or the “Service”).
Your privacy is important to us, and we do our best to protect your personal information and ensure that information is kept private and secure. This “For Humans” section is a user-friendly guide to help you understand our privacy policy. It is in no way a replacement, and may not be thought of, as the full policy. Know that when you accept this agreement, you are accepting our full Privacy Policy and not just the “For Humans” section.

  • Any time you go on our website or mobile application (“app”), or log into your account, you are allowing us to collect information according to this policy. Your use is your consent.
  • When you visit and use the Service, we collect personal information, such as your name, email address, IP address, password, and any other information you provide. We do our best to protect this information and only use it to make the Service available to you.
  • We work with third-party services, like Facebook, Stripe, and Acuity Scheduling, to make instavet simpler to use. If you use a third-party service through instavet you are also consenting to their privacy policies, so be sure to read those policies as well.
  • Cookies are identifiers we may place on your computing device to identify you when you visit the Service. You are not required to accept any cookies, but may want to in order to better utilize the Service.
  • We do not sell, rent, or trade any information that you provide us or share any of your information with any third-parties, except:
    • When legally necessary; or
    • To protect the safety of our users.
  • We will take all reasonable steps necessary to protect your information, but, as a user, you must also protect your username and password from falling into the wrong hands.
  • We may change parts of this policy from time to time, so it is important to check it frequently. If significant changes are made we will do our best to notify you.

HOW YOU ACCEPT THIS POLICY
When you visit instavet, sign up for an account, or otherwise provide us with any personal information, you consent to the terms and conditions of this Privacy Policy. If you do not agree to any part of this Privacy Policy, then we cannot provide the Service to you, and you should stop accessing the Service and delete your account.

Please note that our Privacy Policy contains some capitalized terms. These terms are defined in our Terms of Service, which is incorporated by reference into this Policy. We encourage you to review our Terms of Service, which can be found here www.instavet.com/terms.

INFORMATION WE COLLECT AND WHY
In order to provide you with high-quality services and verify your identity, we collect, store, and process various types of information when you visit or use instavet.

As a Visitor
We may collect various types of anonymous information about visitors to the Service, such as device-related information (e.g., device, browser, and IP address) and server log information (e.g., date and time of your visit). We use this information to better understand our visitors and to enhance your experience on instavet.

As a User
When you sign up for your user account, we will also collect certain personal information as part of your user profile such as your first and last name, email address, and a password. We use this information in order to allow you to schedule appointments on, and to utilize the Service.

We suggest that you provide enough information in your profile so that our Pet Helpers, including drivers and technicians, get a sense of who you are and why they should agree to provide help to your pet. If you choose, you can optionally store additional information, such as your phone number, zip code, street address, social media profiles, occupation, or birthday.

One of instavet’s useful features is the ability to search for Pet Helpers nearby using geolocation tools. If you allow the Site to use your current location, your address will populate the field and you will be able to request the service to that pick-up location.

With respect to geolocation data we collect on the app, we use that information for various purposes, including for you to be able to view the Pet Helpers that are close to your location, for you to set your pick-up location, so the Pet Helpers are able to find your pick-up location, to send you promotions and offers, and to allow you (if you choose through any features we may provide) to share this information with other people. Except as otherwise permitted in this Privacy Policy, we will not share this information with third parties for any purpose and will only use this information for the sole purpose of providing you with the ability to request services via our app. You may at any time no longer allow our app to use your location by turning this feature off on your mobile device.

We may also collect various other types of personal information related to your use of instavet, such as communications made directly to us or our employees or agents, and any additional information you may provide if you contact us for technical support.

THIRD-PARTY SERVICES
We utilize various third-party services to maintain instavet (collectively “Third-Party Services”), such as Acuity. If you authorize us to connect with these Third-Party Services, you grant us the permission to collect certain personal information, such as your name, email address, and any other information that the third-party service makes available to us. Your use of these Third-Party Services is governed by their Terms of Service and Privacy Policies. We will use and disclose such information in accordance with this Privacy Policy.

Instead of signing up directly on the instavet platform, we also give users the option to sign up through their social media accounts, such as Facebook. With your permission, we may collect login credentials from these third-party social networks. Possible uses include: making it easier to set up your instavet account, making it easier for you to share information about your use of the Service, and making it easier for you to share pictures and other media related to your use of the Service.

We further manage our payments through Braintree (owned by Paypal). Information necessary to complete payout includes name, email, phone number, address, date of birth, routing number, and account number. If you make any payments through instavet, you will have the option of saving your payment information to speed up future payments. Payment information is not stored in the instavet database, but is securely stored using the third-party service Stripe (for more information, visit https://www.stripe.com).

COOKIES
We may set and access cookies on your computer or mobile device when you use instavet. “Cookies” are small computer files transferred to your computing device that contain information such as user ID, user preferences, lists of pages visited and activities conducted while using the Service. We may set and access cookies on your device when you use instavet. You are not required to accept any cookies; however if cookies are impaired or disabled, you may not be able to log in successfully and/or some features of instavet may not function properly.

ANALYTICS
We also use a tool called “Google Analytics” to collect information about your usage of the Site. Google Analytics collects information such as how often you visit the Site, what pages you visit when you visit the Site, and what other websites you used prior to coming to the Site. We only use the information we get from Google Analytics to improve our Site. Google Analytics only collects the IP address assigned to you on the date you visit the Site, not your name or other identifying information. We do not combine the information collected through the use of Google Analytics with personally identifiable information. Although Google Analytics plants a permanent cookie on your computer to identify you as a unique user the next time you visit, the cookie cannot be used by anyone but Google. Google’s ability to use and share information collected by Google Analytics about your use of the Site is restricted by the Google Analytics Terms of Use and the Google Privacy Policy.

You can prevent Google Analytics from recognizing you on return visits to the Site by disabling cookies on your browser. You can opt out of Google Analytics by installing the Google Analytics Opt-out Browser Add-on here.

HOW WE USE YOUR PERSONAL INFORMATION
Your personal information is primarily used for the creation of an instavet user account profile and to enable you to access the Service. We also use your personal information to:

  • Provide you with information you request, and respond to correspondence that we receive from you;
  • Provide, maintain, administer, or expand the Service, perform business analyses, or for other internal purposes, to support, improve, or enhance our business, instavet, and other products and services we offer;
  • Send you information about instavet;
  • Contact you when necessary or requested;
  • Customize and tailor your experience of the Service;
  • Send emails and other communications that display content that we think will interest you according to your preferences; or
  • Prevent, detect, and investigate security breaches and potentially illegal or prohibited activities.

As part of this process, we may aggregate some of your personal information in certain data analysis, and may display this information publicly or provide it to others. When aggregating personal information, we make sure that the information is not identifiable to any particular user.

HOW LONG WILL WE RETAIN YOUR INFORMATION
We will retain your personal information, unless you terminate your account or request that we delete it. To make such a request, please send us a note at [email protected].

WHEN DO WE SHARE YOUR PERSONAL INFORMATION
We do not sell, rent, or trade any information that you provide us or share any of your information with any third parties, except as provided below.

We may disclose personal information in response to service of legal process, such as a court order, summons, subpoenas, or as permitted or required by law when we reasonably believe it is necessary or appropriate to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, or violations of our Terms of Service.

We may disclose potentially personally identifying information to employees, contractors, and affiliated organizations that: (i) need to know your personal information in order to provide services available on instavet, and (ii) have agreed not to disclose your information to others. Some of these employees, contractors, or affiliated organizations may be located outside of your home country. By using instavet, you consent to the transfer of such information to them.

Information about our users, including personal information, may be disclosed or transferred to entities, now or in the future, affiliated with us or as part of any merger, acquisition, change of control, debt financing, insolvency, bankruptcy, or sale of our assets. Such information may be used in the businesses of any entity so receiving it.

CHILDREN
instavet is not intended for and may not be used by children under the age of eighteen (18). We do not knowingly collect information from children under the age of 18 and we do not target our Service to children under the age of 18. You cannot sign up for a user account if you are under 18. If you learn that a child under the age of 18 has created a user account with instavet or provided us with personally identifiable information, please contact us at [email protected].

YOUR CHOICE AS A USER
Once your instavet user account profile has been created, you can review and revise that information directly on the website or app. If you have any problems, you may also contact us at [email protected].

PROTECTION OF PERSONAL INFORMATION
The security of the information you provide is extremely important to us. We employ several physical and electronic safeguards to keep your information safe, including encrypted user passwords and securing all connections with industry standard transport layer security.
If you log into your account on a shared computer, be sure to sign out of your account when finished. If you believe a third party has access to your account, you must let us know as soon as possible.
Even with all these precautions, we cannot fully guarantee against the access, disclosure, alteration, or deletion of data through events such as, but not limited to, hardware or software failure or unauthorized entry or use.
ONLINE TRACKING AND DO NOT TRACK SIGNALS
Online tracking is the collection of data about an individual’s Internet activity used to deliver targeted advertisements and for other purposes. Some web browsers (including Safari, Internet Explorer, Firefox, and Chrome) incorporate a “Do Not Track” (DNT) or similar feature that signals to websites that a visitor does not want to have his/her online activity and behavior tracked. If an online service elects to respond to a particular DNT signal, the service may refrain from collecting certain personal information about the browser’s user. Not all browsers offer a DNT option and there is currently no industry consensus as to what constitutes a DNT signal. CHANGES TO THIS POLICY
We may modify this Privacy Policy at any time. Any changes to the Privacy Policy will be reflected on this page and will become effective immediately upon posting. If the changes are significant, we will do our best to notify you via email or through a notification on the website or app. Please check the effective date below to determine if there have been any changes since you last reviewed the Privacy Policy.

YOUR RIGHTS AS A CALIFORNIA RESIDENT
Residents of California have the right to request from us certain information with respect to the types of personal information we share with third parties for those third parties’ direct marketing purposes and the identities of the third parties with whom the business has shared such information during the immediately preceding calendar year. TERMS & CONDITIONS OF SERVICE

For purposes of these Terms of Service, the following terms have the meaning set forth below.

Instructions
We cannot accept instructions from anybody under the age of 18 years or if you do not permanently reside in the United States of America (“USA”), or if you are not at least 18-years of age.

In certain situations, we understand that requests will be made by persons acting as your agent, such as pet carer, cattery/kennel owner, etc.

We will assume unless advised in writing by yourself, that they have your authority and are acting in your interest and on your behalf.

Requests for any account details to be changed must be made in writing by the account holder.

Services
Everest Veterinary Care PLLC dba InstaVet is a full-service urgent care, wellness care, and emergency veterinary practice, specializing in domestic pets. That is to say, we provide the best possible service at your premises. We have the equipment and ability to perform almost all treatments and investigations at your home. Consultations are typically performed in your home. However, we are not a veterinary hospital and do not have the associated facilities to treat pets requiring extended hospitalization. If you are happy with the limitations, we are happy to accommodate you as best we can.

Client Transfer
In filling in the registration request form or registering by phone you are requesting to change services from your previous vets to InstaVet services. This is to include ALL routine veterinary care and emergency treatment plus provision of ALL preventative veterinary medications and prescription medications.

Medication
We cannot supply medication on prescription without first seeing your pet. Repeat prescriptions can only be given if the animal is under direct care and attention of the attending veterinary surgeon, and we reserve the right in certain circumstances to re-examine the animal again before prescribing. All prescriptions must be paid for in advance.

Important Note
We are unfortunately unable to answer queries here made by owners whose animals are not under our veterinary care. We suggest that you discuss your concerns with your own vet. They are in the best position to advise you since they have the benefit of knowing all about your animal and their relevant lab results etc.

Insurance
It is your responsibility to submit claim forms to us for completion. Insurance form administration is provided free of charge by us and all claim forms will be dealt with promptly. Only on rare occasions and by prior arrangement will we defer the ‘payment’ terms below, providing the insurance claim will be paid directly to InstaVet and providing the insurance company has agreed in principle to settle the claim. In this circumstance, the client will still be required to pay any excess and costs not covered by the insurer and any costs later rejected by the insurer.

Second opinions
If you are unhappy with the treatment or progress of your pet, we can arrange for a second opinion from another veterinary surgeon at your cost.

Treatment
Subject to our professional duties as veterinary medical professionals, we reserve the right to make final decisions on treatment.

We retain the responsibility for case records, including radiographs, ultrasound scans, and similar documents. Although the client is charged for the taking, diagnosis, and advice of such radiographs and similar diagnostics, they do not buy ownership of them. In appropriate circumstances, copies can be forwarded to another veterinary surgeon.

Service Limitations
We reserve the right but are not obligated, to limit the sales of our Services to any person, geographic region, or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any Services that we offer. We reserve the right to discontinue any Service at any time. Any offer for any Service made on this site is void where prohibited. We do not warrant that the quality of any Service, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

Payment
We accept credit cards for payments. We will take your credit card details prior to confirming your appointment. We will, thereafter, charge your credit card after the appointment is completed. ALL CHARGES FOR SERVICES PERFORMED ARE NON REFUNDABLE.

We do recognize that there will be exceptional circumstances where emergencies occur and payment at the time will not be possible. Of course such scenarios will be taken into consideration.

To allow us to continue to provide a quality service, this condition will also apply to insured animals and it is the responsibility of the client to be reimbursed by the insurance company.

In giving instructions, either in person or by your agent, for an animal(s) to be treated, you will be responsible for all charges presented on the invoice and services once performed, are considered NON REFUNDABLE under any and all circumstances.

Whenever possible we will give you an estimate of the cost of treatment, however, variations and complications may arise resulting in further costs being incurred.

We reserve the right to charge a “No show/cancellation fee” for any visits or appointments canceled within 24 hours of confirmed time. Appointments canceled at least 24 hours in advance of confirmed time are exempt. If an animal is fractious and cannot be safely examined, a travel fee to account for the veterinarian’s time will be applied to your visit.\

New clients
Details, including relevant medical history, will be obtained from the previous attending veterinary doctor. Obtaining these records is in the interest of your pets’ welfare to ensure we know about any current medical conditions, treatment being received, etc.

All new clients are encouraged to carefully read these terms and conditions.

Limited License to Use Website
We grant you a nonexclusive, nontransferable, revocable and limited license to use the Website in accordance with these Terms. Any copyright or attribution notice appearing on the original content or information must appear on all copies of the content or information. Any document created based on information from the Website is your work product, which you use at your own risk, and we assume no liability for its use.

No Commercial or Non-Permitted Usage
This Website is intended for use by individuals and other entities interested in the market, business, or other information concerning InstaVet. We have exercised efforts to provide you with accurate information on the Website from public or other sources but we are not in any way responsible for your use or reliance on such information, which is solely at your own risk. The use, reproduction, copying, resale, or redistribution of any non-public content of the Website for commercial or any other non-permitted purpose is prohibited without our prior written consent.

Unlawful Activity
You may not use the Website or its content in any way that violates the laws or regulations of any jurisdiction or any political subdivision thereof. We reserve the right to investigate complaints or reported or unreported violations of these Terms and to take any action deemed appropriate including, without limitation, reporting any suspected unlawful activity to law enforcement officials, regulators, or other appropriate third parties and disclosing any information necessary or appropriate to such persons or entities including, without limitation, information related to user profiles, e-mail addresses, usage history, posted materials, IP addresses, and traffic information.

Our Intellectual Property Rights
Except as expressly provided in these Terms, nothing contained herein shall confer, or shall be construed as conferring, any license or right, by implication, estoppel or otherwise, under copyright or other intellectual property rights. You agree that the Website is or may be protected by copyrights, trademarks, service marks, patents or other proprietary rights and laws, and may not be used except as provided in these Terms without our prior consent. You also agree that we retain all copyrights in the layout and graphics of the Website, the collective and compilation copyrights in all databases and navigation design in relation to the Website, and all content of the Website created by our employees, contractors, consultants, or other contributors.

Use of Our Service Marks and Trademarks
You may use our trademarks in referring to the Website or its content without our permission, provided that you follow standard trademark usage practices and provide proper attribution. The Website provides information concerning InstaVet but it is not a substitute for advice from a licensed professional. Your use of this site does not create any fiduciary relationship between you and us. The accuracy of the content of the Website is neither warranted nor guaranteed and you use the Website at your own risk. You agree that you have not and will not detrimentally rely on any information received in connection with your use of the Website.

Non-Reliance, Assessment and Understanding, Status and Assumptions
Each time you use the Website, you represent to us as follows: (a) You have made your own independent decision to use the Website and its content and as to whether such use is appropriate or proper based upon your own judgment and upon advice from such advisers as you have deemed necessary.
